Fees: Instruments must be rented for a minimum period of 3 months. All fees for the initial 3 month rental period are due at the beginning of the initial 3 month rental period and must be paid by cash, or charged to a valid credit card. This initial payment is non-refundable. After the initial 3 month period, this will be a monthly rental agreement. Monthly fees are non-refundable.

Deposit: Renter must provide a valid credit card to be on file. If Renter does not provide a valid credit card, Renter will be subject to a deposit fee of at least $200 prior to the rental period. If the Renter is declared in default of this Agreement as outlined herein, Renter’s deposit will be forfeited.

Rental Purchase Option: Song of Songs will apply 100% of Renter’s first 12 months’ rent toward the purchase of the rented instrument, or any other like instrument of equal or greater value. This special offer applies only if that item is purchased immediately at the end of the initial 12 month rental period. Rental credit stops accumulating after the first 12 months. Renter agrees to forfeit any accumulated purchase credit for failure to pay or return an instrument. No other fees or charges paid shall apply toward the purchase price (tax, maintenance, and repair fees do not apply). For the avoidance of doubt, Renter shall not acquire ownership of the rented instrument unless Renter exercises the purchase option. Upon exercise of purchase option, Song of Songs will transfer title of the rented instrument and the manufacturer's warranty (if applicable) of the rented instrument to Renter.

Late Charge: If rental payment is not received within 14 days after it is due, a $5 penalty will be charged to Renter, or taken out of Renter’s deposit for each month that this account is delinquent. Late fees do not add to Renter’s equity for rental purchase option.

Credit Card Authorization: If Renter is more than 30 days delinquent, Song of Songs is authorized to charge Renter’s credit card on file plus any late fee(s) due, for the rental. If the Renter is declared in default of this Agreement as outlined herein, Song of Songs is authorized to charge Renter’s credit card on file for the total sums owed under this Agreement including any remaining balance up to the full retail price to purchase the equipment plus any late fees.

Default: Song of Songs can declare a Renter to be in default if (i) Renter fails to pay a scheduled rental payment and late charge within 60 days after the due date of the scheduled rental payment; (ii) Renter breaches a promise/obligation under this agreement; (iii) Renter filed misleading or inaccurate information on this agreement; or (iv) any other circumstance that Song of Songs feels endangers the safety of the equipment.

Replacement Coverage (Loss/Damage Waiver): Renter is responsible and liable for the loss or damage of the rented equipment other than ordinary wear and tear. In the event of loss or theft, or damage beyond repair of rented equipment, Renter will be responsible for compensating Song of Songs in an amount equal to the Retail Purchase Price of the equipment in question, less any applicable rental payments. Song of Songs will subsequently provide a replacement instrument of equal quality. Proof of loss and circumstances satisfactory to Song of Songs will be required. For this coverage, rental account must be current and Renter must file a police report within 24 hours and notify Song of Songs within 48 hours.

Repair and Maintenance: Song of Songs will make the appropriate repairs and adjustments to keep the equipment in proper playing condition as long as the account is current. This does not include the restoration of finish, willful damage, careless handling, cleanings or replacement of expendable accessories such as but not limited to strings, rosin, reeds, etc. Renter is responsible for the maintenance and servicing of the rental equipment.

Loaner: In the event that the rented equipment needs to be returned for repairs taking more than 3 working days, a loaner may be provided by Song of Songs, free of charge (subject to availability).

Size Upgrade: Song of Songs will exchange a rental instrument for the next size up at any time. Renter will retain all accumulated purchase credits.

Personal Items: Song of Songs is not responsible for Renter’s personal items left in cases of returned instruments.

Return of Instrument and Termination: Renter may return the instrument to Song of Songs at any time. This Agreement will be terminated once Renter’s instrument is returned to Song of Songs, provided all fees have been paid up to the date of return. THE INSTRUMENT MUST BE RETURNED TO THE SONG OF SONGS STORE ONLY. Returns made more than 7 days after current month's due date will be charged for a full month's rental fee.  Song of Songs has the right to terminate this Agreement at any time Renter is declared in default in this Agreement as defined herein.

Not Assignable: This Agreement and/or instrument is not assignable by Renter at any time and may not be rented to others.

Direct Debit Terms & Conditions: By signing the Credit Authorization box above, Renter authorizes the automatic debiting of the credit card on file for monthly payments under this Agreement. Monthly fees will be charged to the credit card on file on the date this Agreement commences. This agreement will remain in effect until you notify Song of Songs in writing. If there is an error, you are responsible for notifying Song of Songs.

 

 

*Agreement between Song of Songs and Renter pertains only to the renting of the instrument. Arranging instruction and usage of instrument is at the Renter’s sole discretion and responsibility.
